1. Agreement to Terms

By accessing or using TouchMe ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

The Service is operated by TouchMe NZ Limited ("we", "us", or "our") and is intended for use in New Zealand in compliance with the Prostitution Reform Act 2003.

2. Eligibility

To use TouchMe, you must:

• Be at least 18 years of age
• Be a New Zealand citizen or resident (for providers)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under NZ law
• Provide accurate and complete registration information

3. Account Registration

When you create an account, you agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must immediately notify us of any unauthorized use of your account or any other security breach.

4. User Conduct

You agree NOT to:

• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Engage in any illegal activities
• Share explicit content involving minors (strictly prohibited)
• Impersonate another person or entity
• Circumvent any security measures
• Scrape or collect user data without consent
• Use the Service for human trafficking or exploitation
• Post content that violates intellectual property rights

5. Provider Terms

If you register as a service provider, you additionally agree to:

• Complete our verification process truthfully
• Only advertise services you are legally permitted to offer
• Comply with all NZ health and safety regulations
• Maintain accurate pricing and availability information
• Respond to client enquiries professionally
• Not engage in any form of coercion or exploitation

6. Content Guidelines

All content you post must comply with our Content Guidelines. We reserve the right to remove any content that violates these guidelines without notice.

You retain ownership of your content but grant us a license to use, display, and distribute it on our platform.

7. Payments & Subscriptions

Provider subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these terms or required by law.

We offer a 7-day money-back guarantee on your first payment. Subsequent payments are non-refundable but you may cancel future billing at any time.

8. Disclaimers

TouchMe is a platform that connects adults. We do not employ providers, guarantee the quality of services, or verify claims made by users beyond our stated verification process.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL LIABILITY FOR ANY INTERACTIONS BETWEEN USERS.

9. Limitation of Liability

To the maximum extent permitted by law, TouchMe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Continued use after changes constitutes acceptance.
